NO PURCHASE IS NECESSARY TO ENTER OR WIN IN THIS CONTEST. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The ÒARE YOU A DIME PIECEÓ CONTEST (ÒContestÓ) starts at 12:00:01 am ET on 3/5/06 and closes at 11:59:59 pm ET on 4/16/06 (the ÒContest PeriodÓ) and shall consist of eleven (11) events (ten (10) Local Market Events plus one (1) online event as detailed below) (each, an ÒEvent, collectively referred to herein as ÒEventsÓ). Each Event will have its own entry period (each, an ÒEvent Entry PeriodÓ) within the Contest Period. The Event details are as follows:

The sponsors of this Contest are Boost Mobile, LLC, a subsidiary of Sprint Nextel Corporation, 8845 Irvine Center Drive, Irvine, Ca 92618 and Universal Motown Records Group 1755 Broadway New York New York 10019 (the ÒSponsorÓ). The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein.
IMPORTANT NOTICE: YOU MAY ENTER AS MANY OF THE EVENTS THAT YOU LIKE, HOWEVER THERE IS A LIMIT OF ONE (1) ENTRY PER PERSON PER EVENT. ENTRIES THAT DO NOT MEET THE REQUIREMENTS SPECIFIED BELOW WILL BE DISQUALIFIED AND WILL NOT BE JUDGED.
ELIGIBILITY. This Contest is only open to females who are legal residents of the fifty (50) United States and the District of Columbia and twenty-one (21) years of age or older as of the date of entry. Employees of Sponsor, and their respective parent, affiliates, subsidiaries and related companies, advertising and promotion agencies and WEST COAST MARKETING, a Division of The Susquehanna Hat Company (collectively, the ÒPromotion PartiesÓ), and their immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the household of same, whether or not related, are not eligible to enter or win. Individuals who are members of any guild or currently under contract with any talent or modeling agency or any third party which might interfere with her ability to enter into agreements with any of the Promotion Parties or their designees, as determined by the Sponsor, in its sole and absolute discretion, are also not eligible to enter or win. This Contest is void in Puerto Rico, all U.S. territories and possessions, overseas military installations and where prohibited by law. By entering, entrants agree that they have read these Official Rules and to abide by and be bound by all terms of these Official Rules.
HOW TO ENTER: Local Market Events: To enter at a Local Market Event, visit the Contest booth at the applicable Event location specified above during that Event Entry Period and follow the directions provided to submit your entry. You will be asked to complete an entry form, submit a recent clear photograph of yourself and in fifty (50) words or less provide your reason(s) why you should be a ÒDime PieceÓ (collectively, the ÒentryÓ). Photo can be in black and white or color and must be between 4Ó x 6Ó and 5Ó x 7Ó in size. All entries must be received by the specific deadline for each Event as detailed above. Note: Sponsor reserves the right to photograph, film, videotape or otherwise record Local Market Events (ÒMaterialsÓ). Attendance at any Local Market Events constitutes your agreement (i) to participate in the creation of such Materials and (ii) that Sponsor shall own all such Materials (and all rights embodied therein) and that its and it designees may exploit, edit, modify, and distribute the Materials and all elements of such Materials, and all names and likenesses embodied therein, in any and all media now known or not currently known (including on SponsorÕs website), without compensation, permission or notification to you or any third party, except as prohibited by law.
How to Enter the Online Event: During the Online Event Entry Period, you may enter at www.areyouadime.com (ÒWeb SiteÓ). You must read and accept theses Official Rules and follow the directions to complete and submit your entry. Photograph can only be submitted in JPEG or GIF format and can be no larger than 1 MB uncompressed. NOTE: SUBMISSION OF PHOTOGRAPHS SHALL BE SUBJECT TO THE ÒARE YOU A DIME PIECE CONTESTÓ PROGRAM TERMS AND CONDITIONS AVAILABLE AT WWW.AREYOUADIME.COM (ÒSUBMISSION TERMSÓ). After you complete your submission, you will be required to click on the ÒI accept the Official RulesÓ checkbox and click on the ÒARE YOU A DIME PIECEÓ Contest Online Entry Release FormÓ checkbox and following that, click on the ÒEnter The ContestÓ button. ALL ONLINE ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON 4/16/06.
All entries become the property of Sponsor and will not be returned. Limit one (1) entry per person per Event.
The Promotion Parties and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, the ÒReleaseesÓ) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online or e-mail systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Web Site or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; or for any other errors or problems of any kind relating to or in connection with the Contest, whether computer, network, technical, printing, typographical, human or otherwise or any combination thereof, including, without limitation, any errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes or in any Contest-related materials. Proof of submitting an entry is not considered proof of delivery or receipt. Illegible and incomplete entries will be disqualified. All entries become the property of the Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. By entering the Contest, entrants affirm that they have read and accepted these Official Rules.
The laws of the State of New York apply to and govern this Sweepstakes and any claims must be raised and resolved in the Federal or state courts located in New York County, New York, United States.
WINNER SELECTION: Winner selection in the Contest shall consist of the Event Semi-Finalist Winner Selection process and the Grand Prize Winner Selection process as detailed below. All eligible entries received for each Event will be judged in each round of judging according to the following criteria:
1) appearance (30%)
2) photogenic quality (30%)
3) Creativity and originality (20%) Ð how innovative or unique are your reasons why you should ÒBe a Dime PieceÓ?
4) Clarity (20%) Ð are your reasons clear and compellingly presented?
Event Semi-Finalist Winner Selection:
The Event Semi-Finalist Winner Selection shall consist of two (2) rounds of judging; a Preliminary Round and a Final Round.
Preliminary Round Judging: All eligible entries received for each Event will be judged in the Event Semi-Finalist Preliminary Round judging following the conclusion of the Event Entry Period at issue. Event Semi-Finalist Preliminary Round judging will be conducted by qualified judges made up of marketing and management personnel of Nick Cannon. The ten (10) eligible entries judged to have achieved the ten (10) highest scores according to the above-specified criteria, as determined by Sponsor, shall then have their submitted entries re-judged in the Semi-Finalist Final Round of judging. Sponsor reserves the right to not choose ten (10) Event Semi-Finalists for an Event if, in its sole discretion, it does not receive an eligible and qualified entry for the Event at issue.
Final Round Judging: The Semi-Finalist Final Round of judging shall be conducted by Nick Cannon immediately following the conclusion of the Event Semi-Finalist Preliminary Round judging. The one (1) eligible entrant judged by Nick Cannon to have achieved the highest score according to the above-specified criteria, as determined by Sponsor, shall be declared the Event Semi-Finalist Winner. Sponsor reserves the right to not choose an Event Semi-Finalist Winner for any Event if, in its sole discretion, it does not receive an eligible and qualified entry for the Event at issue.
In the case of a tie in either round, the Event Semi-Finalist(s) and/or Event Semi-Finalist Winner will be determined from such tied entries on the basis of the entryÕs rank in the first criterion, continuing in descending order thereafter to the second and third criteria, as needed to break the tie.
Potential Event Semi-Finalist Winners will be announced at the conclusion of the judging process at each Local Market Event and must be present at time of announcement to be declared a potential Semi-Finalist Winner for the Event at issue or place as a Semi-Finalist Winner will be forfeited and, at SponsorÕs discretion, a runner-up will be announced. Sponsor may, at its sole discretion, repeat this process at any Event until five (5) potential Semi-Finalist Winners are determined for such Event or until Sponsor determines, at its sole discretion, that it has exhausted all qualified and eligible entries received for that Event. Potential Event Semi-Finalist Winner of the Online Event will be contacted by telephone and/or mail. If Sponsor is unable to contact the potential Event Semi-Finalist Winner of the Online Event within a reasonable period of time, her place as the Online Event Semi-Finalist Winner will be forfeited and, at SponsorÕs discretion, a runner-up will be notified. Potential Event Semi-Finalist Winners will each be required to execute and return an Affidavit of Eligibility/Release of Liability/Submission Release/Transfer of All Rights and Waiver Agreement form, a completed IRS W-9 form, and a Publicity Release form (unless prohibited by law) within three (3) days of date of issuance of notification. A prepaid return overnight delivery air bill will be provided to facilitate the return of all required documents. Failure to return all required documents fully-executed by the specified deadline or comply with these Official Rules may result in the forfeiture of place as an Event Semi-Finalist Winner and, at SponsorÕs discretion, a runner-up may be selected for the Event at issue. Any notification returned to Sponsor or its fulfillment company as undeliverable for any reason will be forfeited and, at SponsorÕs discretion, a runner-up may be notified for the Event at issue. If a runner-up selection is necessary for any reason, the entry with the next highest total score shall be declared the Event Semi-Finalist Winner or Grand Prize Winner (as applicable) for the Event at issue.
Grand Prize Round:
Each of the eleven (11) Event Semi-Finalist Winners will have her entry judged according to the identical criteria specified above. Grand Prize Round judging shall be conducted by Nick Cannon. The compilation of the total score judging of the Grand Prize Round shall be completed by 4/21/06 (date is subject to change depending on final dates of Semi-Finalist Round). The one (1) eligible Event Semi-Finalist Winner with the highest score, as determined by Sponsor, shall be declared the Grand Prize Winner of this Contest (ÒGrand Prize WinnerÓ). In the case of a tie, Grand Prize Winner will be determined from among such tied Event Semi-Finalists on the basis of the Semi-FinalistÕs rank in the first criterion, continuing in descending order thereafter to the second and third criteria, as needed to break the tie.
The Grand Prize winner will be notified within seven (7) days of the conclusion of Grand Prize Round judging.
Sponsor shall have the right to disqualify any entries that it deems to not meet the criteria, or due to technical, legal or other problems, which are inappropriate for publication on SponsorÕs Web Site for any reason, or which it deems to be obscene or otherwise not in good taste, as determined by Sponsor in its sole discretion. Entries may not defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any personÕs personal or proprietary rights. Sponsor and JudgesÕ decisions are final and binding with respect to all matters relating to this Contest.
PRIZES: Semi-Finalist Prize (11) (one (1) prize per Event): Each Semi-Finalist Prize consists solely of a weekend trip (Saturday night stay over required. Specific dates of travel are to be determined by Sponsor and are subject to change) for one (1) person to Los Angeles, CA (ÒLos AngelesÓ) to take part in the Finalist Round of judging as detailed above, including (i) round-trip (ÒR/TÓ) coach air transportation (on carrier(s) selected by Sponsor) between the major U.S. gateway city airport closest to the winnerÕs residence and Los Angeles, (ii) two (2) nights hotel accommodations (one (1) single standard room) at a hotel selected by Sponsor plus (iii) admission for the winner to a taping of Wild N Out. The approximate retail value (ÒARVÓ) of each Semi-Finalist Prize is US $750. The actual value of the prize will depend on the winnerÕs point of departure.
All travel arrangements must be made through SponsorÕs agent. All meals, gratuities, ground transfers, insurance, incidentals and any other costs and expenses not specified herein as being awarded are the sole responsibility of the Semi-Finalist Prize winner. If the Semi-FinalistÕs residence is within 75 miles of the greater Los Angeles metropolitan area, air transportation will not be included in the prize package and no additional prize element will be substituted in full satisfaction of SponsorÕs obligations hereunder. The Semi-Finalist Winners must travel during the dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such Semi-Finalist. Semi-Finalist Prize winners will be required to provide government issued photo identification and any other required travel documentation at time of travel. No changes will be made to travel details once any portion of travel arrangements has been made. Certain travel restrictions may apply.
Grand Prize: (One (1) Grand Prize will be awarded): The Grand Prize consists solely of a trip (Specific dates of travel are to be determined by Sponsor and are subject to change) for one (1) person to SponsorÕs choice of Los Angeles, CA or New York, NY, including (i) round-trip (ÒR/TÓ) coach air transportation (on carrier(s) selected by Sponsor) between the major U.S. gateway city airport closest to the winnerÕs residence and destination city, (ii) two (2) nights hotel accommodations (one (1) single standard room) at a hotel selected by Sponsor, (iii) R/T airport/hotel ground transfers in destination city, (iv) the opportunity to participate in an upcoming Nick Cannon video shoot and (v) one time, final compensation for the video shoot of $300. Note: If the Grand Prize winner does participate in the Nick Cannon video shoot portion of the prize, there is no guarantee that the winnerÕs performance will be included in the final presentation version of the video. ARV of Grand Prize is US $1,050. The actual value of the prize will depend on the winnerÕs point of departure.
All travel arrangements must be made through SponsorÕs agent. The total approximate retail value of the prizes to be awarded in this Contest is US $9,300.
All details and features of prizes shall be determined by Sponsor in its sole discretion. Prizes are not transferable or redeemable for cash. No substitution, transfer or cash equivalent of a prize by the winner is permitted except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. All applicable federal, state, local or other taxes, including but not limited to income and withholding taxes, are the sole responsibility of winners.
GENERAL: This Contest is subject to all applicable federal, state and local laws and regulations. All entrants represent and warrant that any material that he or she submits is original, has not been previously published or won an award, does not infringe upon the copyright or any other right or interest of any other person or organization, and that the entrant has not previously granted any rights to such material to any other person or organization, nor does any third party have any interest in such materials. Sponsor reserves the right to conduct background checks on any Semi-Finalist Winner and reserves the right in its sole discretion to disqualify any person based on such background check if Sponsor determines in its sole discretion that awarding a prize to such potential Semi-Finalist Winner might reflect negatively on Sponsor or any of the Releasees. By entering this Contest, entrants (i) agree that all entries and any other materials submitted (whether acceptable or not, regardless of the form they take) will be owned exclusively by Sponsor, and (ii) grant Licensees (as defined below) the absolute and exclusive right and permission to edit, modify, publish, exploit and use the content of and elements embodied in the entry (including the essay and photo) and the entry itself worldwide in perpetuity in any and all media (whether now existing or hereafter devised) (including in SponsorÕs advertising and marketing campaigns, including but not limited to online, in-store and promotional materials) and in any manner, for trade, advertising, promotional or any other purposes without further approval, permission or consideration. Entrants also agree that Sponsor, its affiliated and subsidiary companies, licensees, designees and assigns (collectively, ÒLicenseesÓ) shall have the right and permission to use the name, city and state of residence, signature, voice, picture or other likeness, entry, and/or entry information of entrant in any manner or media now or hereafter known (including, without limitation, placing entrantÕs name, signature, entry, and/or entry information onto the SponsorÕs web site or other site promoting this Contest) without further consideration or notification to or permission from entrant or any third party, except where prohibited by law.
Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contest or acceptance of or use or inability to use a prize (including and travel or activity related thereto) or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Entrants release the Releasees from any and all liability and responsibility with respect to the prizes (including any property loss, damage, personal injury, death or travel related hereto). Winner acknowledges that the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prizes.
If a prize (or portion thereof) cannot be awarded due to circumstances beyond the control of the Sponsor, a substitute prize of comparable or greater retail value will be awarded at the discretion of the Sponsor. Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond ReleaseesÕ sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage.
If for any reason this Contest (or any portion thereof) is not capable of running as planned or does not allow the proper playing of the Contest and processing of entries per these rules, or if tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in SponsorÕs sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual (and void his/her entry) implicated in such action, and/or to modify or terminate the Contest (or any portion thereof) or further entry in this Contest, as Sponsor deems appropriate. If modification or termination of this Contest occurs, notification will be posted on the web site at http://www.areyouadime.com and Sponsor may, at its discretion, select potential Semi-Finalist Winners from among all eligible, non-suspect entries received for the Event at issue up to time of action. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
